- Abuse of Powers of Attorney: Also called a "breach of trust" or "breach of fiduciary duty," this happens after an elderly individual who is no longer competent to make financial decisions gives Power of Attorney over his or her belongings to a trusted individual. If that trust is abused, then heirs that feel shortchanged often file suit.
- Undue Influence: In some cases, an individual who has gained the trust of a vulnerable, elderly individual may manipulate them into giving him or her a greater share of the estate than is really fair. It can be difficult to prove whether or not the elderly individual was competent when making the decision, and often people allege undue influence when none took place.
